A new law signed by Florida Governor Ron DeSantis clarifies that emails sent by debt collection agencies between 9:00 p.m. and 8:00 a.m. are not in violation of state law.
The clarification comes in response to an existing rule that prohibited collectors from contacting debtors during nighttime hours. Emails are now excluded from that ban, as they are considered less intrusive than phone calls.
In the U.S., debtor protection laws are particularly strict, and the lack of clear rules on this point in Florida had triggered multiple lawsuits against collection agencies.
